These Terms of Use govern access to and use of the TavanMind website, dashboard, software services, technical demo materials, pilot program workflows, and related clinical decision support tools.

By accessing or using TavanMind, you agree to these Terms. If you use TavanMind on behalf of a clinic, company, university, institution, or other organization, you represent that you have authority to accept these Terms on behalf of that organization.

1. About TavanMind

TavanMind is a clinical decision support software platform for cognitive assessment, behavioral reporting, longitudinal monitoring, and structured clinical documentation.

TavanMind provides descriptive behavioral summaries and structured data to support professional reasoning. It is not a standalone diagnostic system and does not replace qualified clinical judgment.

2. Eligibility

TavanMind is intended for professional use by:

  • licensed or qualified clinicians;
  • therapists;
  • clinical organizations;
  • researchers;
  • clinic administrators;
  • authorized staff;
  • pilot clinic participants;
  • approved organization or vendor administrators.
  • You may not use TavanMind if you are not authorized to do so by your organization or by TavanMind.

3. Account Access

Users are responsible for:

  • keeping login credentials secure;
  • using only their own authorized account;
  • not sharing credentials;
  • notifying TavanMind or the clinic administrator of suspected unauthorized access;
  • ensuring that account information is accurate and up to date.
  • TavanMind may restrict, suspend, revoke, or terminate access if there is suspected misuse, unauthorized access, license violation, security risk, or breach of these Terms.

4. Organization and License Administration

Where TavanMind is provided under an organization license, access may depend on:

  • organization approval;
  • license status;
  • seat availability;
  • device activation;
  • user role;
  • account activation;
  • administrator invitation;
  • revocation status;
  • subscription or contract terms.
  • TavanMind may enforce technical license controls, including activation checks, seat management, dashboard access rules, and device-linked access.

5. Permitted Use

You may use TavanMind only for lawful, authorized, professional, and clinically responsible purposes.

You agree not to:

  • access accounts, organizations, patients, reports, or systems without authorization;
  • attempt to bypass authentication, authorization, licensing, or access controls;
  • reverse engineer, copy, resell, or redistribute the software except where expressly permitted;
  • interfere with the security or availability of the platform;
  • upload malicious code;
  • misuse demo, pilot, or trial access;
  • enter unnecessary sensitive information into free-text fields;
  • use TavanMind as a standalone diagnostic authority;
  • use the platform in a way that violates applicable law, professional standards, or patient rights.

6. Clinical Responsibility

TavanMind supports clinical reasoning but does not make final clinical decisions.

The qualified professional remains responsible for:

  • selecting appropriate assessments;
  • ensuring proper test conditions;
  • interpreting results;
  • reviewing reliability warnings;
  • considering patient history and clinical context;
  • making clinical decisions;
  • communicating results responsibly;
  • obtaining any required consent;
  • complying with professional and legal obligations.

7. No Emergency Use

TavanMind is not designed for emergency medical decision-making, crisis intervention, or urgent risk assessment.

If a patient requires urgent medical, psychiatric, neurological, or safety-related intervention, users must follow appropriate professional and emergency procedures.

8. Pilot and Founding Clinics Program

TavanMind may offer technical demos, pilot access, or Founding Clinics Program participation.

Pilot or complimentary access may be subject to:

  • eligibility review;
  • separate written terms;
  • data protection requirements;
  • privacy obligations;
  • feedback participation;
  • usage limitations;
  • time limits;
  • professional oversight;
  • validation or standardization protocols.
  • Complimentary access does not guarantee permanent free access, certification, validation status, or commercial availability.

9. Reports and Outputs

TavanMind reports are generated from cognitive task data, scoring models, behavioral patterns, reliability checks, and structured report templates.

Reports may include:

  • reaction time metrics;
  • accuracy metrics;
  • omission and commission indicators;
  • working memory indicators;
  • reliability warnings;
  • behavioral pattern summaries;
  • longitudinal trends;
  • descriptive interpretation.
  • Reports are informational and decision-supportive. They are not standalone diagnoses.

10. Data Accuracy and Test Conditions

Users are responsible for ensuring reasonable test conditions, including:

  • appropriate hardware;
  • stable device performance;
  • proper patient instructions;
  • suitable environment;
  • accurate patient information;
  • valid test administration;
  • review of reliability warnings.
  • TavanMind may flag low-quality data, but it cannot guarantee that all invalid testing conditions will be detected.

11. Intellectual Property

TavanMind, including its software, interface, reports, scoring logic, content, design, trademarks, documentation, and related materials, is owned by or licensed to the operator of TavanMind.

You may not copy, modify, distribute, sell, sublicense, reverse engineer, or create derivative works from TavanMind unless expressly authorized in writing.

12. Feedback

If you provide feedback, suggestions, reports, ideas, or improvement requests, you allow TavanMind to use that feedback to improve the product without obligation to compensate you, unless otherwise agreed in writing.

Patient-identifying information should not be included in general feedback unless necessary and authorized.

13. Third-Party Services

TavanMind may rely on third-party infrastructure and services for hosting, authentication, database, analytics, email, security, or support.

Use of these services may be subject to their own terms and privacy policies.

14. Availability and Changes

TavanMind may update, modify, suspend, or discontinue features, pages, workflows, dashboards, or pilot functionality.

We aim to maintain reliable service but do not guarantee uninterrupted or error-free access.

15. Disclaimer of Warranties

TavanMind is provided on an "as is" and "as available" basis unless otherwise stated in a written agreement.

To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and error-free performance.

16. Limitation of Liability

To the maximum extent permitted by law, TavanMind and its operators shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of data, loss of revenue, business interruption, clinical misinterpretation, or unauthorized use caused by user-side negligence, unless otherwise required by law or contract.

Nothing in these Terms limits liability where limitation is not permitted by applicable law.

17. Termination

TavanMind may suspend or terminate access if:

  • the user violates these Terms;
  • the organization license expires;
  • access is revoked by an administrator;
  • payment or license conditions are not met;
  • unauthorized use is detected;
  • legal or security risks arise.

18. Governing Law

Unless a separate written agreement states otherwise, these Terms shall be interpreted under the laws applicable to the legal entity operating TavanMind.

For commercial clinic agreements, the governing law and dispute resolution terms may be defined separately in the signed contract.
